Joe has focused his litigation practice on commercial, trust and estate/probate, creditor/bankruptcy and real estate disputes. Over his career in private practice, his experience also includes contract, tort, fraud, insurance defense and coverage, employment, civil rights, personal injury, and aviation litigation.

Experience
  • Representing Petters bankruptcy Trustee responsible for unwinding the multi-billion dollar Ponzi scheme and pursuing clawback claims to recover money for the bankruptcy estate.
  • Pursuing complex post-judgment remedies on behalf of insurer judgment creditor to collect multi-million dollar judgments by uncovering hidden assets, piercing the corporate veil and retrieving fraudulent transfers. 
  • Defended real estate developer in $16 million construct defect claim involving 12 building condominium complex and obtained favorable settlement after surgical use of summary judgment to shift liability to other parties in case.  
  • Representing trustees, personal representatives and beneficiaries in several current disputes over estate planning instruments, will contests and claims of breach of fiduciary duty in estates and trusts of all sizes.
  • Negotiation, drafting and dispute resolution involving leases, sale transactions, mechanics’ liens, mortgage loans, security interests, guaranties, receiverships, equity stripping, zoning, land use, condemnation, lender liability, evictions, common area charges, including successfully zeroing out a landlord’s $600,000 claim seeking improper operational costs from our client who had leased a New Jersey warehouse.
  • Litigated several aviation accident cases, including trial verdicts against Northwest Airlines for passenger hearing loss, and the FAA for runway collision; and a major settlement against the FAA for weather-related general aviation crash.

Search Tips:

You may use the wildcard symbol (*) as a root expander.  A search for "anti*" will find not only "anti", but also "anti-trust", "antique", etc.

Entering two terms together in a search field will behave as though an "OR" is being used.  For example, entering "Antique Motorcars" as a Client Name search will find results with either word in the Client Name.

Operators

AND and OR may be used in a search.  Note: they must be capitalized, e.g., "Project AND Finance." 

The + and - sign operators may be used.  The + sign indicates that the term immediately following is required, while the - sign indicates to omit results that contain that term. E.g., "+real -estate" says results must have "real" but not "estate".

To perform an exact phrase search, surround your search phrase with quotation marks.  For example, "Project Finance".

Searches are not case sensitive.
