Eric Nystrom is an experienced trial lawyer who has tried significant cases in state and federal courts and administrative forums in 10 states. He also has arbitrated before the American Arbitration Association’s Centre for International Dispute Resolution. Most recently, Eric was lead trial counsel in a three-week jury trial in Minnesota Federal District Court in which he obtained a multi-million dollar verdict in December 2011 on behalf of American Bank of St. Paul and 25 participant banks. American Bank’s claims arose from TD Bank’s complicity in an extensive fraud perpetrated by disgraced Orlando businessman and boy-band promoter Louis J. Pearlman.

In over 23 years of practice as a business and commercial litigator, Eric has represented clients in a wide variety of industries, including telecommunications, banking and financial services, insurance, manufactured housing, window manufacturing, pressure-sensitive-label manufacturing, heavy-industrial construction, industrial metal recovery, food packaging, and temporary employment and recruiting. His representation of these clients has involved complex contract disputes posing novel and difficult damage claims; Uniform Commercial Code disputes revolving around breaches of warranty, contract formation, and economic and non-economic losses; large-scale product failures; insurance recovery on behalf of policyholders under general liability, directors and officers, environmental, and employment practices policies; shareholder litigation for closely-held businesses; and internal corporate investigations.

As a result of his work for this diverse group of clients, Eric is sought out for his expertise in handling difficult and complex disputes, and he has successfully prosecuted and defended lawsuits involving claimed damages in the hundreds of millions of dollars. He also has worked with numerous experts in engineering, statistics, and finance and accounting to successfully present complex technical issues, factual scenarios and damage claims in an understandable and persuasive way to jurors, judges, arbitrators and mediators.

While clients rely on Eric primarily for successful resolution of their disputes, they also consider him a trusted advisor because of his knowledge and understanding of their businesses and business objectives. Eric represents both publicly and privately-held companies, and has acted as outside general counsel to a number of his privately-held clients.
