Jon Bye Discusses the HDR Whistleblower Settlement with Minnesota Lawyer


Minnesota Lawyer recently interviewed Jon Bye and his client Mark Essling to discuss their recent whistleblower case that resulted in a $30 million settlement and $5.7 million award. In 2006, Essling, the CEO of Health Dimensions Rehabilitation of Cambridge, MN, was listening to an earnings call with the CEO of RehabCare, one of the largest therapy providers at nursing homes in the country. On the call Essling heard the CEO of mention a $600,000 “recruitment fee” his company recently paid to a nursing home chain when it entered into a new contract, saying it was paid to recruit the therapists who worked at these homes to stay on with RehabCare. Essling suspected this violated the anti-kickback statute, prompting him to call Bye.

“The therapists need the jobs. They want to come back to work. There is no need to pay them in this situation. Many of them moved to the area for this job and set their schedules accordingly,” Bye said. “That’s what [Essling] brought this knowledge of how the system works.”

You may use the wildcard symbol (*) as a root expander.  A search for "anti*" will find not only "anti", but also "anti-trust", "antique", etc.
